The Privacy Policy, where you will find useful information regarding the protection of your data and the use of cookies (A.) and the Other Legal Information (B.) are dealt with in the following sections.

A. Privacy Policy

1. Introduction

23bis considers the protection of your privacy and your personal data as very important. This is why we are keen to inform you in a transparent manner about the way we collect and process the data transmitted to us. This Privacy Policy (hereinafter: "the Policy") explains to you what data is processed, for what purposes and how. You will also find information on the use of cookies.

2. What is personal data?

The term "personal data" means any data/information relating to an identified or identifiable natural person. In other words, it means any information that can be directly or indirectly linked to a person, such as, for example, name, address, telephone number or IP address.

3. Nature and purpose of the collection of your personal data

In general, we collect personal data in two situations: when you subscribe to the 23bis Newsletter (1.) and when you submit a request to 23bis via the contact form on our website (2.). In addition, when you interact with 23bis via our social media such as Facebook and Instagram, your personal data is collected by the third parties in question and processed for their own purposes. Please also note that when you visit our websites, we collect other types of data, cookies, as described in section 8 below.

In both of the above-mentioned cases, the purpose is simply to provide you with the information you have requested or to enable you to achieve the purpose for which you have provided your data. It is important to us that you can communicate easily with us and vice versa. We collect your data for this purpose and always take care to respect the balance between these interests and your rights. In addition to processing your personal data for the purpose for which you have provided it, we reserve the right to use some or all of your personal data for other purposes, such as conducting a survey or offering you the opportunity to take part in a competition, but we will not, under any circumstances, pass on your data to third parties (see point 7 below).

4. Duration of preservation of personal data

23bis keeps your personal data for as long as it deems necessary for the purposes for which it was collected, in compliance with the legislation in force. Your personal data will be deleted as soon as 23bis no longer needs it.

5. Secure processing of personal data

23bis ensures that your data is protected. Appropriate technical and organisational measures are implemented to prevent unauthorised access, disclosure or processing. Our website uses SSL certificates authenticated by a third party. Despite all the efforts made by 23bis, it should be noted that the transmission of information via the Internet and other electronic media entails a number of risks. 23bis is not responsible for the data you transmit to it.

6. Access to your personal data

You can ask 23bis to have access to your personal data at any time. 23bis may correct or delete information about you at your request, which may however limit its ability to communicate with you. We invite you to send us your request to the contact details given in section 10 below.

7. Sharing of personal data

In general, we do not pass on any data to third parties. If we were to pass on your data to a third party, because this seems necessary to achieve one of the purposes for which you have passed it on to us, for example to an external company that provides services requiring the processing of personal data, these third parties may only use your data for the purposes intended by 23bis. Consequently, they will not be able to use this data for their own purposes or pass it on to other third parties. In any case, we will never sell your data to third parties. We may pass on your personal data if we deem it necessary, in the context of legal proceedings, at the request of a court or authority or in accordance with other legal obligations, in order to protect our rights or property. We only disclose what is strictly necessary for legal purposes.

8. Use of cookies

The first time you visited the 23bis website, a banner informing you about the use of cookies was displayed. Cookies are small files which are placed on your computer when you visit the 23bis website. Our cookies are used to make your browsing experience smooth and to evaluate the frequentation and use of our website in order to highlight statistical trends. The data processed by the cookies relate to your use of the website (IP address, geographical origin, date of visit, duration of visit, pages and sections consulted, etc.). These are cookies of a technical nature. No personally identifiable data is obtained or processed. These cookies enable us to improve the performance of our website, to offer relevant content and to ensure that our website is user-friendly and functions correctly.

The 23bis website uses three statistical tools:

a. Google Analytics, a service provided by Google Inc. which collects data on the use of our website (how long our visitors spend on the site, where they click most, which sections are visited most often, etc.). The information collected is anonymous and allows us to generate statistics without you being identifiable.

b. Google Tag Manager, a tag management tool provided by Google Inc. which helps to manage the technology and cookies used on the Messieurs.ch website.

c. Google Ads, a tool provided by Google Inc. that allows to create and monitor digital advertising campaigns based on the keywords used by users when searching on Google.

This data is transmitted to and stored on servers in the USA for Google.The data generated by these cookies is therefore subject to foreign legislation. Google may be required by law to disclose this data to third parties. They will not associate your IP address with any other data held by Google. Please note that Google will anonymise your IP address before saving it and has adhered to the "Privacy Shield" legal framework for data protection between Switzerland and the USA.

By simply continuing to browse the website of 23bis or by selecting "Yes, I accept" on the banner for the use of cookies, you indicate your agreement with the use of cookies. You can check this use at any time by various simple means, which 23bis makes available to you here:

We draw your attention to the fact that such deactivations could prevent the use of certain functionalities of the 23bis website. We therefore recommend that you leave cookies activated. If you configure your browser in such a way that it blocks even the strictly necessary cookies, you will certainly no longer have access to the entire 23bis website.

Most third party providers also offer modules that allow you to disable the cookies they use. 23bis provides no guarantee in connection with the use of these tools, developed by third party companies. Third-party cookies, such as Google Analytics, can last up to fifty months, after which they are automatically deleted. Fixed cookies remain stored on your computer or device until they are deleted or expire.

Finally, Facebook, Instagram and other third-party tools and social media may set cookies for content sharing on their tools. These social networks may place their own cookies on your computer or device. As we do not control these cookies, we invite you to consult the relevant third party platforms for more information on their use of cookies.

9. Links to other websites or social media

The 23bis website may provide links to other websites and social media. Access to these sites and their use are the responsibility of the users, as are the information and services offered by these platforms, which are the sole responsibility of their authors.

11. Modifications

Messieurs.ch may amend, supplement or revise this Policy from time to time. If there is a significant change, we will inform you thereof. Nevertheless, we advise you to consult our Policy regularly in order to be aware of any possible changes.

Any reproduction, distribution, modification or copying is subject to the prior written approval of 23bis. Otherwise, such use of the 23bis website is expressly prohibited. The publication of a link to the 23bis website is also subject to the latter's written approval.
